Increased fees from IP Australia

As we outlined in our previous alert, Act now to avoid IP Australia fee increases, from 1 October 2020, various fees charged by the Trade Marks Office of IP Australia have changed.

The key changes are as follows:

  1. for a standard application filed online, the official fee increases from $330 per class to $400, unless the specification of goods or services uses the ‘picklist’ provided by IP Australia (where the fee stays at $250)
  2. for an application filed other than via the online portal, the official fee increases from $350 to $450
  3. for applications in Australia based on prior overseas registrations, the fee increases from $350 to $400 per class (this change will commence on 7 November 2020)
  4. when applying for a series of marks, the fee increases from $480 per class to $550, assuming the picklist is not used
  5. for requesting an opposition, the fee decreases from $600 to $400
  6. for attending trade mark hearings, the fee increases from $200 per day to $600 for phone or video attendance and $800 for personal attendance.

There are other changes to the fees for design and patent applications.

CGLaw’s professional fees for assisting clients with searches, applications, and all other trade mark work have not increased.
